Terms of Use

The rules that frame Never Forget: your account, the plans on offer, and each party's commitments. Creating an account constitutes acceptance of these terms.

Purpose

These terms of use (ToU) govern access to and use of the Never Forget application, published by Claire Lavigne (see Legal notices). They apply to anyone who creates an account or uses the service. By signing up, you acknowledge that you have read and unreservedly accept these terms.

User account

Using Never Forget requires creating an account with a valid email address. You are responsible for keeping your credentials confidential and for all activity carried out from your account.

An account is strictly personal. You must be at least 15 years old, or have the authorization of a legal guardian.

The service

Never Forget is an everyday-life organization app: tasks, lists, routines, celebrations, health tracking, documents, and reminders. The service is available online through a browser and provided "as is".

The publisher may change, add, or remove features at any time in order to improve the service.

Plans and pricing

Never Forget is offered under two plans:

Free

0 € — no commitment

Unlimited tasks and categories, task and birthday reminders, one list, two health trackers, and three documents.

Pro

5 € / month or 39 € / year

Unlimited routines, lists, health trackers, and documents, extended reminders, and sharing of every space.

Prices are shown inclusive of all taxes and may change; any price change has no effect on a period already paid for.

Subscription and payment

Payment for the Pro plan is handled by our provider Stripe; no banking data is stored by Never Forget. The subscription renews automatically at each term (monthly or yearly) until it is cancelled.

You can cancel at any time from your profile. Cancellation takes effect at the end of the current period, with no pro-rata refund, and your account then automatically switches back to the Free plan.

In accordance with Article L221-28 of the French Consumer Code, you agree that performance of the service begins upon subscription and you waive, for the period already started, your fourteen-day right of withdrawal.

Your obligations

You agree to use Never Forget in accordance with the law and these terms. In particular, you must not:

  • attempt to access accounts or data belonging to others;
  • disrupt, overload, or compromise the operation of the service;
  • store or distribute unlawful content;
  • use the application for fraudulent purposes.

Failure to comply with these rules may result in suspension or deletion of the account.

Availability and liability

The publisher does everything possible to ensure the availability and reliability of the service, without being able to guarantee continuous, uninterrupted operation. The service is provided "as is".

The publisher cannot be held liable for indirect damages or loss of data; it is up to you to keep a copy of important information.

Personal data

The processing of your personal data is described in detail in the privacy policy. By using Never Forget, you accept its terms.

Intellectual property

The application, its code, its design, and its content are the exclusive property of the publisher (see Legal notices). You do, however, retain full ownership of the content you create in the application — tasks, lists, documents, and other personal data.

Termination and deletion

You can delete your account at any time from Profile → Delete my account, which permanently and irreversibly erases all your data. The publisher may, for its part, suspend or close an account in the event of a breach of these terms.

Changes to the terms

The publisher may modify these terms to adapt them to changes in the service or in regulations. Users are informed of substantial changes; continued use of the service after they take effect constitutes acceptance of the updated terms.

Governing law

These terms are governed by French law. Failing an amicable resolution, any dispute relating to their validity, interpretation, or performance falls under the jurisdiction of the French courts.
